This trial was highly problematic from the beginning. There was contradicting witness statements, a severe lack of physical evidence, and it could also be said that the judge and jury were too close to the case to give a unbias verdict.

Problematic Witnesses
​
The initial witness statements from the Talbott family about the events before and after the murder were relatively the same. However, throughout the trial it was clear that none of the other statements lined up, except when manipulation came into play. Read more about these witnesses

Troubling Timeline
​
The trial started began in January 1881, less than three months after the arrest of the Talbott boys. The murder trial ended after only ten days. The conviction and death sentence was given in March. Albert and Charles' lawyer presented the case to the Missouri Supreme Court and the verdict was upheld. The execution took place on July 22, 1881.

From the day when Doc Talbott was mudered, to the time when the Talbott boys were unlawfully executed for the crime was a time frame of only 11 months. The initial trial was far too short for a murder trial and when they went to the MO Supreme Court, they should have had another trial that lasted at least a year.
